Assignment 4

(Due October 12)

        Moore v. The Regents is considered one of the most important property decisions of the last 40 years.  It is an example of common law.

Your assignment is to carefully read and analyze this case from the perspective of law and economics.   Before you being to read Moore v the Regents, you should read the "Manual for First Time Case Readers" which is on E-Reserve for Econ325.

 

        Please answer the follow questions.  

 

(1) What happened? When did it happen?

         Set up a time line of events. The issues in the case will be clearer when you have this time line to look at.

 

(2) What are the three major issues under consideration in the case?

 

(3) What was the majorities decision?

 

(4) What additional issues were raised in the "Concurring" & Dissenting opinions?

 

(5) What efficiency issues are the judges considering as they make their decisions?

 

(6) What definition of efficiency do they seem to be using?

 

(7) What equity issues are the judges concerned with?

 

(8) What definition of equity do they seem to have in mind?

Upload you answers to the above questions to the Assignment 4 folder in the Econ325-Drop conference in First Class before class on October 12.

On October 12, I will call on students at random to answer the above questions. We also have a class discussion of the case; so, you need to read the case very carefully.
